Who owns the sidewalk?

A story in today’s Globe follows a couple of Boston code enforcement police around as they issue citations to folks who shovel/plow/blow snow into the already plowed street. The story mentions that unnamed “legal experts” say the city is liable for injuries that occur on sidewalks so it’s in the city’s interest to strictly enforce the ordinance that requires property owners to shovel the sidewalk in front of their property. I’ve already written about this issue in light of this past summer’s Supreme Judicial Court decision on snow removal liability, but a clear answer as to who bears legal responsibility remains elusive.
